The agency prepares drafts of Opinions in order to assist the European Commission in its preparation of proposals for basic principles, applicability and essential requirements to the European Parliament and to the European Council. The Agency also prepares guidance material relating to the application of implementing rules. (Article 18 of the Basic Regulation).
These Opinions to the Commission are Agency Rules. They are submitted to the European Commission, and are listed on this page together with supporting documents produced in the course of the Agency's Rulemaking procedure. The analysis made showed that the provisions of Article 7.3.(c) of EC 2042/2003 should not be amended and that the date specified should be maintained.
This rulemaking activity was not originally included in the Agency's rulemaking programme for 2006. In accordance with the provisions of Article 3(6) of the rulemaking procedure, the rulemaking programme has been adapted as appropriate. Considering the urgency of the issue no Terms of Reference was published for this task.
